We’re posting them here to help keep you up to date on what’s going on.

The Dallas, Texas City Council will soon consider major changes to the Dallas animal control ordinance. The changes include breeder permitting, limits on the number of pets that can be owned, stricter dangerous dog language, and a ban on tethering.

Breeder Permitting
This proposed ordinance mandates that you spay or neuter your dog unless you obtain a breeder permit for each intact dog.
Breeder permits will only be issued to owners of dogs of "recognized" breeds.
The permit will cost $500 per year and will restrict breeding to one litter per permit per year. Further, breeders are prohibited from selling puppies until they reach eight (8) weeks of age and have been immunized.
In order to redeem a dog from impoundment, it must be spayed or neutered or the owner must purchase a breeder permit for that animal.
Breeder licensing fees place an undue burden on responsible breeders and owners and fail to address irresponsible individuals who neither comply with existing law nor will comply with new regulations. Such fees therefore punish responsible breeders who give the care and attention that puppies need in order to grow into healthy, well-adjusted companions and neighbors. Responsible local breeders also provide a support system to new owners; assisting them with housebreaking, training questions, behavior issues and basic new puppy care inquiries. Further, mandatory spay/neuter is an ineffective solution to animal control problems because it fails to address the heart of the issue—irresponsible ownership. Mandatory spay/neuter laws are extremely difficult to enforce and can be evaded by irresponsible animal owners by not licensing their pets. More regulations increase the workload of already financially strained animal control offices, making it even more difficult for them to perform their duties.

Pet Limit
The proposal also creates a limit of six dogs or cats or combination of both per dwelling.
There will be a grandfather clause for current owners who list all their current animals with the Director of Animal Services and are in compliance with all other regulations.
There will also be an exemption to foster care providers who have been approved by the Director of Animal Services.
Not only are limit laws easily evaded and difficult to enforce, they fail to address the heart of animal control problems--irresponsible ownership. Effective implementation of existing leash and curbing laws, rather than passage of new burdensome regulation, would prevent pet owners from allowing their animals to run loose, while clean-up ordinances would require owners to take responsibility for their pets.

Dangerous Dogs, Tethering and Confinement Requirements
The draft ordinance requires all dogs deemed dangerous to be spayed or neutered.
The owner of a dangerous dog must obtain liability insurance of $100,000.
Any dog that has been determined to be dangerous by another jurisdiction will not be allowed into the city.
Any tether used must be at least 10 feet long and be attached to the dog's collar or harness and not the dog itself.
The area in which dogs are kept must be at least 150 square feet per dog, if the dog(s) lives primarily outside.
The AKC believes the answer to population issues is strict enforcement of leash and nuisance laws, rather than passage of new burdensome regulation. The key to resolving this issue is to implement and expand the wide range of programs available to educate the public about responsible breeding and animal ownership practices.

CALL TO ACTION!!!! URGENT ANNOUNCMENT AT FEDERAL LEVEL

FELLOW ANIMAL OWNERS:

WE MUST ACT NOW! WE MUST DEMAND FEDERAL PROTECTION & RELIEF from the state
to state assault by animal rights organizations such as HSUS & PeTA resulting in the LOSS OF OUR PROPERTY RIGHTS!

Word has been sent from Washington, D.C., that it appears HSUS is already using the mandatory spay/neuter vote in Los Angeles, during which the council leader specifically thanked HSUS for their help, to impress upon the US Congress that Californians are OK with mandatory spay/neuter and loss of property rights! This ordinance is illegal. It is uti lizing illegal underground rules to circumvent state law.

We have been so busy defending our counties & states, that we have neglected
contacting our Federal representatives and now HSUS has slipped in around
our flank, walking the halls of Congress and whispering that CALIFORNIANS
SUPPORT MSN. Congressional representatives take that into consideration that
therefore, WE DO NOT CARE ABOUT OUR PROPERTY RIGHTS!

We must IMMEDIATELY CONTACT EVERY FEDERAL office TODAY!

We must do this as a concerted effort to bring our plight to light!

Call, fax & email each & every one of the below listed Federal officials.
Start with the President, and don't stop until you get through the list. The
two links will take you to Federal Congressional members. Grab a cup of
coffee and make this your day's objective. We must do this en masse, not
some time next week. Email this CALL TO ACTION to every person you know,
every list you belong to------ EVERYONE!

Use the following cases to make your points:

CASE 1

The Los Angeles SPCA is using gun wielding thugs to pry our pets from our
hands and is targeting senior citizens.

This is illegal as Article II - Section 12 of the CA Constitutional states:

The Legislature SHALL NOT give any power to a private corporation or person.
This kind of illegal action is also a violation of the Anti-Trust Hobbs Act.

In essence, the animal rights organizations like SPCA & HSUS through strong-arm tactics, are putting animal welfare & animal enterprise entities OUT OF BUSINESS.
They are attacking rescue, small Humane Societies, breeders, commercial breeders and
pet shops, in an effort to MONOPOLIZE the pet sale industry. This is no different than
giving guns to Wal-Mart which then goes to raid K-Mart in which all of
K-Mart's property is seized and placed f or sale at Wal-Mart because Wal-Mart
did not like the way K-Mart displayed their wares.

Attached is a picture of ARMED SPCA thugs in Los Angeles about to enter a
courtroom and who were subsequently arrested for entering a courtroom ARMED.
This is ILLEGAL as they are NOT peace officers of the law. This was a
violation of Statute 830.9 - Impersonating a peace officer.

CASE 2

In Pasco County where county officials are ILLEGAL LY notifying LAW ABIDING
breeders with longtime VALID kennel permits and business licenses that they
must disperse their animals to comply with the new interpretation of county
law which is nine dogs rather than the limit of 49 as reads the kennel
permit, we again see the elderly being targeted. This also violates inter
and intra-state Federal law, Title 18. Protecting commerce and free
enterprise.

Case 3

The Humane Society of the United States (HSUS) was in possession of a video
that supposedly showed a downed dairy cow at a processing plant in
California. It has been confirmed that downed cows were NOT used in
processing at this plant. Animal rights groups have long been known to
fabricate videos to claim animal abuse. The fact though is th at HSUS waited
three weeks to reveal this video when a more timely presentation to the USDA
would have allowed for instant investigation and thusly would have protected
our food supply and would have protected the cows from mistreatment. After
the media blitz by HSUS, they asked for donations based on this video. The
result: Senator Boxer submits an emergency request to take ALL BEEF products
off the school lunch menus in California. The vegan agenda of HSUS and PeTA
just claimed a major victory. One or two more steps and our children will
be vegans at least while at school.

This is not unlike the media blitz they ran for Mike Vick's dogs, in which
they claimed to have care & control of the confiscated dogs and asked for
funds for their care, eve n though they did possess even ONE of Vick's dogs.
The result: laws are sweeping the nation banning many breeds which is
resulting in many innocent dogs being confiscated, abandoned or surrendered
to a certain death. The animal rights agenda claims another victory.

The worst example lies in the media blitz after Hurricane's Katrina & Rita
is which HSUS garnered over $34 million dollars in direct donations intended
for the pet victims. HSUS within months left the disaster area with the tens
of millions of dollars leaving the hurricane survivors and their pets
without the promised re-unification. So many complaints were filed with the
Louisiana Attorney General's office due to claims of fraud, missing funds
and missing pets that the HSUS is still under investigation!

HSUS & PeTA are fund raising organizations. Pure & simple. They do not
utilize the funds to save animals. They use these donations to push animal
le gi slation at all levels- federal, state and local. It's time the Federal
government put a stop to the loss of our property rights across the nation.
We are under siege by animal rights groups in states like Califorinia,
Virginia, Washington, Arizona and Kentucky, and counties from the Los
Angeles on the West Coast to Palm Beach on the East Coast . The AETA (Animal
Enterprise Terrorism Act) was designed to protect citizens and commerce. We
must demand that it be ENFORCED. We must demand RELIEF from illegal laws
that violate federal law and our U.S. Constitution which declares our rights
to property ownership.

I ask you now why do we study history? Why is it important? There are many
aspects of human histor y th at we do not want to repeat. One of these is the
holocaust. One of the first acts of the groups that put Hitler into power
was the formation of a group known as the Stormtroopers or Brownshirts, a
para-military unit with no governmental authority. They obtained the names
of owners that were registered gun owners. Then they went door to door to
these addresses demanding the registered gun be surrendered. If one could
not or did not produce the gun, they were shot & killed instantly. It was an
Auschwitz survivor that told this story in Spielberg's Interviews.

They demand we register & sterilize our pets.

Need I remind you that they also asked the Jews to register all their family
members?

You remember what happened to them?
Let us prevent this history from repeating itself.

Arizona House Bill 2516 has been assigned to three legislative committees: the House Committee on Counties, Municipalities, and Military Affairs; the House Committee on Government; and the House Committee on Rules. The bill, which seeks to prohibit persons from owning or keeping a dog or cat that is more than six months old if the animal has not been spayed or neutered, unless the person has acquired an intact permit for the animal, has not yet been scheduled for hearing. However, it is imperative that all concerned breeders and responsible dog owners in Arizona contact the committee members listed below and voice their strong opposition to the bill.

On January 15th, Palm Beach County Commissioners are scheduled to hold a first hearing on a proposed ordinance which will make drastic changes to the animal control ordinance, dramatically impacting responsible owners and breeders. Although the County Commission directed staff to begin drafting this ordinance back in April of 2007, an amended draft was posted to their website only on January 8th. Furthermore this is only a draft and may still be amended prior to the January 15th meeting.

Concerned dog owners are asked to immediately call the county commissioners and request that consideration of the ordinance be postponed until the February 5th meeting to allow for sufficient public review. Please click here for the County Commissioners contact information.

The ordinance will impose mandatory spay/neuter of any dog over the age of 6 months unless the owner qualifies for and purchases a $75 intact animal license, or declares in writing that the dog will not be used for breeding. The ordinance will further require hobby breeders, defined as any individual that produces up to 2 litters or 19 dogs per calendar year, to buy a permit and to submit to home inspections. Neither the proposed ordinance nor the existing fee schedule list what the fee for this permit will be.
Key points of the legislation:

Qualifications for the intact animal license include:
Registered purebred and the owner certifies in writing that the animal is being used, trained or considered for use in a show, sporting competition or competitive event.
A veterinarian certifies that the dog is medically unfit to be sterilized or:
Dog is a current law enforcement animal or service/guide dog or;
The owner declares in writing that the animal is not to be used for breeding unless an appropriate permit is obtained from the department.
Requires hobby breeders to purchase a permit that:
Limits hobby breeders to 2 litters, or fewer than 19 dogs bred or sold in a calendar year (would count any animals retained for your own use).
Requires that animal control be allowed to inspect the breeders’ premises, without establishing standards or requiring specific training in animal husbandry for the inspectors.
Mandates that each animal must be licensed individually as well ($75 for intact license and $15 for sterilized animals).
Provides that icenses may be revoked for breeding an animal with a known genetic fault, although there is no clarification on what qualifies as a genetic fault.
Mandatory microchip for any animal adopted or released from a shelter, even on a first offense.

The Ohio House of Representatives Infrastructure, Homeland Security, and Veterans Affairs Committee will consider House Bill 366 tomorrow, Wednesday, January 9th, at 2:30PM, in Room 114 at the State Capitol in Columbus. Sponsored by Representative Webster, the bill proposes to remove the current breed specific language from the definition of vicious dogs in state law. The American Kennel Club encourages all Ohio dog owners to attend the committee hearing, or to e-mail or fax the committee members, in support of this sound legislation.

The American Kennel Club supports reasonable, enforceable, non-discriminatory laws to govern the ownership of dogs. We support laws that: establish a fair process by which specific dogs are identified as "dangerous" based on stated, measurable actions; impose appropriate penalties on irresponsible owners; and establish a well-defined method for dealing with dogs proven to be dangerous. The AKC strongly opposes any legislation that determines a dog to be "dangerous" based on specific breed or phenotypic classes of dogs.

This legislation will remove “pit bulls” from state law, while allowing the adoption of local ordinances or resolutions that would define "dangerous dogs" more broadly.

Contact the members of the Ohio House Committee on Infrastructure, Homeland Security, and Veterans Affairs. Tell them that you support this fair legislation.
